rick. i'm jenna lee. we're half an hour away where suspected mass murderer james holmes will hear the formal charges which the rampage killed 12 and lefts to's it of dozen dozen of others injured. holmes had the dyed reddish orange hair. he seemed dazed. this time around we'll not get a look at him because the judge banned cameras inside the courtroom. the judge issuing a gag order in the case. defense attorneys say it has been repeatedly violated pointing to recent leaks to the media and they will likely bring that up as an issue in today's hearing. alicia acuna is live in colorado with more. alicia? >> reporter: jenna, there are a few things on tap for today in addition to the filing of charges. james holmes will be in courtroom number 201 for the filing of charges in the expectation is that at minimum there will be 12 first-degree murder charges. there are two crime scenes that we know of. the theater where the shooting took place and. this is up to the direct attorney. >> carol chambers is an aggressive no-nonsense prosecutor. she debated the death penalty in her own mind. she
wants holmes treated as a terrorist, calling for the feds to get involved now. the grieving dad also choking up as he remembers the last time he spent with little veronica, a camping trip a few weeks back. >> it was the last, the last time i got to see her. e last time i was able to hold her and tell each other that we loved each other. jenna: alicia acuna is live in aurora, colorado with more for us. alicia, we have a look inside the suspect's apartment? >> reporter: we do, jenna. it was a fox news crew that was able to take this video of the interior of holmes's apartment. now they did not cross police barricades to gain access but this does give you an idea what police came upon when they eventually entered his residence. much of what was inside including explosives were destroyed but there was also quite a bit that police were able to gather for evidence purposes. it could be a year before the case against james holmes goes to trial. that according to the district attorney in the case, carol chambers. she said that after holmes's advisory hearing yesterday. the judge has placed a

movie theater unfolds, police say james holmes spent four months ordering ammunition and supplies for the attack and rigged nearly 30 explosive devices in his apartment. later today, president obammal take on the role of consoler in chief, traveling to colorado to comfort victims and their families n. aurora, a city trying to fathom the tragedy, residents will come together for a prayer vigil. i'm shannon bream. we go to the movie theater in aurora and talk to the police chief, one of only two interviews the chief is giving. hello, john. >> reporter: shannon, the police department insists that holmes acted alone. joining us now for one of his first interviews sips the shootings, aurora police chief dan oats. jon scott from outside the theater. there was word overnight, some confusion overnight that there might be a second person involved, a second suspect. you can clear that up for us? >> sure. i would like to correct something. rather than insist he acted alone, we have no information that he acted with anyone else at this time. there was a report overnight about a person who was

. it will be a little longer than the first time that we had a court appearance by james holmes. tell us a little bit some of the other hearing matters that could come up. >> reporter: yes. judge william sylvester also has to make some ruling on a couple more motions. one is a motion by the defense regarding a package it said that in court documents that james holmes sent to his psychiatrist, dr. lynn fenton. the defense argued this package contained privileged information between patient and doctor and wants it turned over immediately. it accused the government leaking manufacturing to the media. 20 media organizations including fox news have a motion with the judge as well there is to unseal certain document in the case and the publics that legitimate interest knowing what action taken by a number of officials in the case. things get underway in the arapahoe court in a few minutes. back to you guys. jenna: alicia, thank you. rick: on to politics now and governor mitt romney wrapping up his high-profile three-nation tour in poland today. the republican presidential candidate is spending the last 36
. james holmes did not enter a plea today. but given the questions about his mental health and the news that he was seeing a psychiatrist legal experts say it's likely the former neuroscience student will try some sort of insanity defense. alicia acuna live in centennial colorado with the news tonight. alyssia, prosecutors still have to decide whether they want the government to kill him for his crimes, if convicted. >> that's right, shep. and the district attorney has indicated that's her preference. but carol chambers has more than a month to decide. today chambers held back on what her office could have charged holmes with, deciding to focus more on the victims in the theater than his apartment building, which police say he rigged to explode. experts say the defense will drag this out. >> given that this is likely a death penalty case, the strategy of the defense is to keep their client alive as long as possible. every opportunity to delay and get continuances i expect we will see that pursued. >> a conviction could also result in several life sentences. shep? >> shepard: what happen
will continue to investigate this entire matter. we will work very hard to understand all of mr. holmes' contacts and acquaintances, but that's largely to learn more about his thinking and his behavior, not that we think there is any suspect in particular that helped him in this. it's a perverse enough crime for one person to formulate it. i don't think it's really conceivable that there is a second person who was in on this -- on this -- on this thing. >> reporter: the timeline that you have laid out suggests that there was roughly four months of planning, at least four months of planning that went into this. do you think that it goes back farther than that? is there any indication from new evidence that it goes back farther? >> well, i will go back to what i know and what i have revealed. he started to receive shipments of all of this stuff around four months ago. obviously, we don't know now -- if we knew, we wouldn't share it with the media, what he was doing prior to that. but i think, as i said yesterday, i think that four months of this kind of activity, accumulating this materia

is going to be traumatic definitely. ually -- we'll see for the first time, we believe, mr. holmes in person in court. there's a report out there he may not appear for his own safety. the report that we have is he'll be walked underground into court and he'll understand what he's up against and we'll get a chance to see his defense team which we understand he's met with. he's not cooperating with police but cooperated enough to let us know his whole apartment was booby trapped and if anyone opened that door, there would have been more carnage. >> it's interesting that he did that. the ultimate plan -->> i can't figure that out. >> i think his ultimate plan was to get away and when he was, then, caught in the movie theater parking lot, i'm not sure why he decided it was a good thing and decided to tell the police officers. otherwise, more lives would have been lost at his apartment complex. back to the court hearing for a minute, the bond will be set. obviously he's probably not going to get out on bond with the crimes that he's facing. it's not expected to last long at all and, of

. james holmes was seeing a psychiatrist before the rampage. this information coming to light as two of the victims are laid to rest. elizabeth has more details. >> reporter: the court filings reveals that james was under the care of a doctor. he doesn't reveal the extent of the treatment but it does say she was the intended recipient of that package which was confiscated by investigators. media reports reveal that dr. franklin was reprimanded by the colorado medical board for prescribing medication to family members while not keeping up updated medical charts. meanwhile, the profiling, to get that notebook will be addressed monday during his arraignment. he faces 12 counts of first-degree murder charges and many more depending on the district attorney carol chambers. >> we want to see how aggressive they want to be. if you charge first degree and serious bodily injury for a bunch of victims there is a lot of medical records and lots of doctors. the trial could stretch out to epic proportions. >> meanwhile, today is mourning for people here in the city have colorado but across the na
